By accessing or using the byiCloud platform, website, or any associated services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use our Services.
These Terms constitute a legally binding agreement between you ("Customer", "User", "you") and A.L.S.I. Technologies ("Company", "we", "us").
If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.
byiCloud provides cloud infrastructure and digital services including, but not limited to:
Services are provided "as-is" subject to the service levels described in Section 7. We reserve the right to modify, suspend, or discontinue any Service with reasonable notice.
To use our Services, you must register for an account. You agree to:

You agree to use the Services only for lawful purposes. You must not use the Services to:
Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without refund.
Fees for Services are as listed on our pricing page and may vary by plan. All prices are in Euros (EUR) and exclude applicable VAT unless stated otherwise.
Subscription plans are billed monthly or annually in advance, depending on your chosen billing cycle. Usage-based charges are billed at the end of each billing period.
We accept payment by credit card, debit card, and bank transfer (for annual Enterprise plans). Payment information is processed securely through our payment providers.
If payment is not received within 14 days of the due date, we reserve the right to suspend your account until payment is made. Accounts suspended for more than 30 days may be terminated and data permanently deleted.
Subscription fees are generally non-refundable. However, if a technical fault on our part caused significant service disruption, we may at our discretion offer a pro-rated credit. Refund requests must be submitted within 30 days to info@byicloud.com.
We target the following service levels:
SLA Credits: If monthly uptime falls below 99.9%, eligible customers may receive service credits. Credits must be claimed within 30 days. Credits are not available for outages caused by factors outside our control including DDoS attacks, upstream provider failures, or customer-caused issues.
All intellectual property rights in the byiCloud platform, software, documentation, and brand are owned by A.L.S.I. Technologies. Nothing in these Terms grants you any right, title, or interest in our intellectual property.
You retain all rights to data, content, and materials you upload or store using our Services ("Your Content"). By using our Services, you grant us a limited, non-exclusive license to process and store Your Content solely to provide the Services to you.
Your use of our Services is governed by our Privacy Policy, which is incorporated into these Terms by reference. We process personal data in accordance with applicable EU data protection laws including the General Data Protection Regulation (GDPR).

To the maximum extent permitted by applicable law, A.L.S.I. Technologies shall not be liable for:
Our total liability to you for any claim arising under or related to these Terms shall not exceed the total fees paid by you to us in the 3 months preceding the claim.
Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
You may cancel your account at any time by contacting us at info@byicloud.com. Cancellation takes effect at the end of the current billing period.
We may suspend or terminate your account immediately if you breach these Terms, fail to pay fees, or if we are required to do so by law. We will give reasonable notice where possible.
Upon termination, your right to use the Services ceases immediately. We will retain your data for 30 days after termination to allow you to export it. After this period, your data will be securely and permanently deleted from our systems.
These Terms are governed by and construed in accordance with the laws of the Republic of Estonia, without regard to conflict of law principles.
Any disputes arising from or related to these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of Estonia.
If you are a consumer in the EU, you may also use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
We reserve the right to update these Terms at any time. When we make material changes, we will notify you by email and/or by posting a prominent notice on our website at least 14 days before the changes take effect.
Your continued use of the Services after the effective date of the updated Terms constitutes your acceptance of the changes.
